We draft, review, and provide Independent Legal Advice for:

 

Cohabitation Agreements –  which can detail each party’s expectations, rights and obligations related to household expenses, asset and debt division, and spousal support during the relationship and in the event of a separation. 

 

Pre-nuptial/Marriage Contracts – which are for parties who are getting married or who are already married and wish to ensure certain assets are protected in addition to specifying each party’s expectations, rights and obligations related to household expenses, asset and debt division, and spousal support during the relationship and in the event of a divorce.

 

Separation agreements –  which address issues of asset and debt division, parenting time of the partner’s children,  child support and spousal support.

 

Both parties should have independent legal advice from a lawyer prior to signing any agreement to ensure that the agreement is fair and legally binding.

We practice Collaborative Family Law which is an alternative dispute resolution process where the parties (married or common law) and their lawyers agree to: 

 

  • negotiate a settlement without taking their dispute to court;
  • communicate and exchange information honestly and in good faith;
  • create solutions that take into account the interests of both parties;
  • the withdrawal of all professionals involved if either party chooses to go to court.  

 

In addition to the lawyers for each party, the collaborative law process may include neutral mental health professionals, financial planners, child specialists and/or divorce coaches. Whether the parties decide to retain these other professionals will depend on their unique situations and needs.

With a limited scope legal service, a client retains a lawyer to perform specific tasks or take responsibility for a specific issue of your case. The client handles the other tasks or issues that would form part of the services a lawyer would provide in a full-service retainer. The client and the lawyer enter into a limited scope agreement which outlines the services the lawyer will provide.

Legal coaching is a type of limited scope service where the lawyer-coach provides  legal advice, support and guidance “in the wings” while the client maintains responsibility for all aspects of the dispute. With this service, the client can control their legal expenses as they can decide when and how much guidance they need from their coach.

As your coach, we will work with you by:

  • Giving legal advice;
  • Explaining laws and rules relevant to your case;
  • Explaining the legal process;
  • Helping you set your short- and long-term goals;
  • Organizing the tasks you need to complete;
  • Providing guidance as you develop a strategy to achieve your goals;
  • Managing your expectations;
  • Reviewing and editing the documents you’ve prepared;
  • Preparing you for court and alternative dispute resolution (ADR) appearances;
  • Assisting with negotiation and settlement discussions.

Mediation is an alternative dispute resolution process whereby parties meet with an impartial professional who will assist them in resolving their family conflict.

 

Mediation is a cost-effective option if you are seeking to avoid prolonged time in Court and want a predictable outcome to your dispute. You will be an active participant in determining the issues and crafting the solutions that are most important to you and your family. 

 

We can assist with conflicts involving:

  • Separation and Divorce, 
  • Division of family property, 
  • Parenting time and decision-making,

  • Child and spousal support; and,
  • Grandparent access
